From time to time, the RMI receives queries from members with regard to the applicability of Main Agreement for the Motor Industry vs. the Basic Conditions of Employment Act.
Members are advised that all employers and employees within the Motor Industry, which fall within the jurisdiction of the Motor Industry Bargaining Council (MIBCO), are bound by the terms and conditions specified in the Main Agreement for the Motor Industry and not the Basic Conditions of Employment Act. Employers in the Motor Industry are thus, not obliged to display the BCEA wall-chart at their premises, but must have a copy of the Main Agreement for the Motor Industry at their premises for the purpose of inspection by employees at the workplace.
Recently, the parties to MIBCO undertook to simplify the Main Agreement, the result of which has been sent to the Department of Labour, for the purposes of promulgation.
The RMI is now making the Main Agreement which was submitted to the Department of Labour available on CD which will also have an in document interactive Table of Contents, this will be at a cost of R55.00 per CD + R20.00 per CD postage. Members, who order 50 CDs or more, will obtain them at a price of R50.00 per CD + postage. Please see further details on attached Order Form. As party to the Main Agreement for the Motor Industry, the RMI regularly assists members with the interpretation of the Agreement as well as the representation of members at various forums.
