The Main Agreement and the Administrative Collective Agreement of MIBCO expired on 31 August 2016. Members are therefore not presently required to remit Council Levies and Union Subscriptions via the monthly MIBCO returns system. Members must however be mindful of the fact that, should they continue to remit these levies and subscriptions through the returns system, they will be unable to claim a rebate / refund at a later stage, as MIBCO has given notice that it will use such payments for its intended purposes and they can therefore not be re-claimed / refunded.
MIBCO circulated a memorandum on the 26th of August 2016 under Circular Number 11/2016, which explains to Members how to go about opting out of these payments on the MIBCO returns system. A copy thereof is attached hereto.
In order to assist Members with the practical steps in opting out of these levies and subscriptions on the returns system, the RMI insisted that MIBCO develop a pictorial process flow chart, which can be downloaded from the MIBCO website at www.mibco.org.za/images/returns/mibcoreturnslevyandunionbreaks.pdf. Please refer to this flow chart should you be unsure as to the process to follow.
Whereas the RMI recognizes and respects Members’ right to opt out of these levies and subscriptions as a result of the expiry of the agreements, it wishes to record its view that MIBCO is of strategic importance to the sustainability of the Industry and parties should therefor ensure the preservation of the Council in order to promote social cohesion and the sustaining of centralized collective bargaining. The RMI therefore implores members to exercise their right to opt out of the MIBCO levies, judiciously.
