The Labour Laws Amendment Bill (‘the Bill’) was passed by the National Assembly, and has now been referred to the National Council of Provinces. The Bill proposes amendments to the Basic Conditions of Employment Act 75 of 1997 (‘BCEA’) by introducing parental leave, adoption leave, the commissioning parental leave (regarding parents in surrogate motherhood agreements) and related benefits from the Unemployment Insurance Fund.
Consequent amendments are also proposed to regarding family responsibility leave in the case of child birth, variation of the BCEA by a collective agreement concluded at a bargaining council, and to the Unemployment Insurance Act 63 of 2001.
