Update on road traffic legislation – Licences and public transport

Please note the Minister of Transport has published amended directives in terms of the Disaster Management Act, 2002 in Government Gazette Nr. 43539 on 22 July 2020. These are the sections you will need to take note of:

SCHEDULE

  1. Definitions
    “Directions” means the Directions on measures to address, prevent and combat the spread of COVID -19: Determination of extension for validity period of learner’s licences, driving licence cards, licence discs, professional driving permits and registration of motor vehicles, published under Government Notice No. 544, in Government Gazette No. 43339 of 20 May 2020.
  1. Amendment of direction 6 of Directions
    The Directions are hereby amended by the substitution for direction 6 of the following direction:
    “6. Validity period of licences

(1) All learner’s licences, driving licence cards, temporary driving licences and professional driving permits that expire during the period that commenced from 26 March 2020, up to and including 31 August 2020, are deemed to be valid and their validity period is extended for a further grace period ending on 31 January 2021.

(2) All motor vehicle licence discs, temporary permits and roadworthy certificates that expired during the period that commenced from 26 March 2020 up to and including 31 May 2020 are deemed to be valid and their validity period is extended for a further grace period ending on 31 August 2020.

(3) Motor trade number licences that expired during the period that commenced from 26 March 2020 up to and including 31 May 2020 are deemed to be valid and are extended for a further grace period ending on 30 November 2020.

  1. Commencement
    This amendment comes into effect on the date of publication in the Government Gazette.

The Minister of Transport has also published directives in terms of the Disaster Management Act, 2002 in GG 43538 on 22 July 2020 for public transport services. The directions published on 4, 6, 22 and 30 May 2020 are withdrawn by this directive.
